Welcome to Teaching Autism / Learning with Nikki.
These Terms and Conditions (“Terms”) govern your use of this website and any associated Teaching Autism / Learning with Nikki websites, online stores, memberships, subscriptions, courses, training programs, digital resources, bundles, downloads, communities, services, and other products made available by Teaching Autism (“Teaching Autism”, “Learning with Nikki”, “we”, “us”, or “our”).
By accessing our website, creating an account, purchasing a product or service, joining a membership, enrolling in a course, participating in a promotion, or otherwise using our services, you agree to these Terms.
Please read these Terms carefully before making a purchase.
Nothing in these Terms affects any rights or remedies that you have under applicable consumer law.
1. About Teaching Autism
Teaching Autism creates and provides educational resources, memberships, digital products, courses, training, and related content primarily for educators, special education professionals, families, caregivers, and others supporting learners with additional needs.
Teaching Autism also organizes collaborative promotions and bundles involving products contributed by independent third-party creators.
Some Teaching Autism websites, products, memberships, courses, or services may operate under the name Learning with Nikki. References to Teaching Autism within these Terms include Learning with Nikki where applicable.
2. Eligibility
You must have the legal capacity to enter into a contract to purchase products or services from Teaching Autism.
Our products, accounts, memberships, and purchasing services are intended for adults.
Where a school, district, business, organization, or other entity purchases a product or service, the person completing the purchase confirms that they have authority to make the purchase on behalf of that organization where applicable.
3. Accounts
Certain Teaching Autism products and services require you to create an account.
You are responsible for:
- providing accurate account information;
- keeping your login details secure;
- maintaining the confidentiality of your password;
- ensuring that unauthorized individuals do not access your account; and
- notifying Teaching Autism if you believe someone has gained unauthorized access to your account.
Unless a product or license expressly permits multiple users, accounts and login credentials are for the registered user's individual use and must not be shared.
Teaching Autism may suspend or restrict an account where we reasonably believe that account sharing, unauthorized distribution, fraudulent activity, copyright infringement, security misuse, or another material breach of these Terms has occurred.
4. Digital Products
Most products sold by Teaching Autism are digital products.
Unless a product listing specifically states otherwise, you will not receive a physical product.
Digital products may include PDFs, ZIP files, PowerPoint files, printable resources, digital activities, videos, recordings, templates, educational materials, course materials, membership resources, or other downloadable or online content.
Customers are responsible for ensuring that they have suitable software, hardware, internet access, printing facilities, or other technology required to access and use a product.
5. Digital Product License
Purchasing a Teaching Autism digital resource gives you a license to use that resource. It does not transfer ownership of the intellectual property to you.
Unless a different license accompanies a particular product, Teaching Autism grants the purchaser a limited, non-exclusive, non-transferable, non-sublicensable license for personal and/or single-user educational use.
A standard resource purchase generally licenses the resource to one individual user unless the product description or applicable license states otherwise.
You may use the resource with the students you directly teach or support within your own classroom or caseload.
You may not share the resource with another teacher, classroom, professional, department, school, business, or organization unless you purchase or obtain the appropriate additional license or Teaching Autism expressly authorizes that use.
6. Permitted Resource Use
Subject to the applicable product license, you may generally:
- use a resource for your own personal or professional educational use;
- use a resource with students whom you directly teach or support;
- print copies for students within your own classroom or caseload;
- make reasonable accessibility or learning modifications for your own students;
- store files on your own password-protected device or personal storage system;
- use resources within a secure, access-controlled digital classroom environment for your own students where appropriate; and
- recommend a Teaching Autism resource to another person by directing them to an authorized purchase page.
Permitted use may vary for particular products. Product-specific license terms take precedence where they expressly differ from these general Terms.
7. Prohibited Resource Use
Unless Teaching Autism provides express written permission or a separate license permits the activity, you may not:
- share purchased files with another teacher or professional;
- upload resources to public websites;
- place resources on school-wide, district-wide, departmental, or organization-wide shared drives;
- distribute resources through public cloud storage;
- resell Teaching Autism resources;
- redistribute Teaching Autism resources for free;
- claim Teaching Autism content as your own;
- copy substantial portions of a resource to create another resource;
- use Teaching Autism resources to create products for resale;
- include Teaching Autism resources within another paid product, membership, course, bundle, training program, or service;
- remove copyright notices or other ownership information;
- provide another person with access to your account to avoid purchasing an additional license; or
- otherwise exploit Teaching Autism content beyond the scope of your license.
8. Intellectual Property
Unless otherwise stated, Teaching Autism owns or licenses the intellectual property rights in its websites, branding, educational resources, photographs, graphics, illustrations, videos, course materials, written content, membership content, downloads, templates, product designs, and other original materials.
Copyright remains with Teaching Autism or, in the case of collaborative products, with the applicable contributing creator.
Purchasing or accessing content does not transfer copyright, trademark rights, or other intellectual property rights to you.
All rights not expressly granted under these Terms remain with their respective owners.
9. Artificial Intelligence and Machine Learning
NO ARTIFICIAL INTELLIGENCE OR MACHINE-LEARNING RIGHTS ARE GRANTED BY A STANDARD PURCHASE OR MEMBERSHIP.
Unless Teaching Autism expressly authorizes it in writing, you may not upload, submit, provide, transmit, or otherwise make protected Teaching Autism content available to an artificial intelligence, generative AI, large language model, machine-learning system, dataset, model-development system, or similar technology for the purpose of:
- training or fine-tuning a model;
- testing or evaluating a model using our protected content;
- text or data mining;
- scraping or automated extraction;
- creating embeddings or retrieval databases;
- developing retrieval-augmented generation systems;
- recreating Teaching Autism resources;
- imitating Teaching Autism resources;
- generating derivative educational products;
- generating competing educational products;
- extracting substantial protected content;
- automated content generation based upon our protected materials; or
- otherwise using Teaching Autism content for model development or unauthorized content creation.
You may not upload a Teaching Autism resource to an AI system and instruct the system to recreate, imitate, adapt, expand, reproduce, or generate additional resources based upon that protected content where doing so exceeds your license.
The fact that Teaching Autism content is purchased from, hosted by, delivered through, or otherwise made available using a third-party platform does not by itself grant permission for that content to be used for artificial intelligence training, machine learning, text or data mining, model development, automated content generation, or similar purposes.
10. Memberships and Subscriptions
Teaching Autism may offer recurring memberships or subscriptions, including access to libraries of digital resources, member-only content, training, communities, or other benefits.
The specific content, features, price, billing frequency, and benefits of a membership will appear on the applicable sales or checkout page.
Unless stated otherwise, recurring memberships continue and renew according to the billing frequency selected at checkout until cancelled.
By purchasing a recurring membership, you authorize the applicable payment provider to collect recurring payments according to the plan you selected until the membership ends or you cancel it in accordance with the applicable cancellation terms.
11. Cancelling a Membership
You may cancel a recurring membership in accordance with the cancellation method made available to you.
Cancellation normally prevents future renewal charges. Unless otherwise stated or required by law, cancelling does not ordinarily create a refund for a billing period that has already begun.
Your access may continue until the end of the period for which you have already paid, unless your account ends earlier because of fraud, serious misuse, intellectual property infringement, or another material breach of these Terms.
Any statutory cancellation rights continue to apply.
12. Membership Content
Membership content remains protected by copyright and the applicable Teaching Autism license.
Membership does not give you ownership of the resources contained within the membership.
Unless otherwise stated, membership access and login credentials are licensed to one individual member and must not be shared.
Downloading a resource while you are a member does not give you the right to redistribute, resell, publish, or share that resource.
Where the applicable membership terms allow you to retain and continue personally using resources legitimately downloaded during an active membership, that permission remains subject to the resource license and these Terms.
13. Changes to Memberships, Products and Services
Teaching Autism continually develops its products and services.
We may make reasonable changes to products, memberships, subscriptions, courses, resource libraries, platforms, features, delivery methods, or included content where there is a genuine reason to do so.
Reasons may include:
- improving or updating a product or service;
- replacing outdated content;
- changes in technology;
- changes to hosting or software;
- security requirements;
- changes in law or regulation;
- intellectual property or licensing requirements;
- changes imposed by a third-party provider;
- changes to marketplace rules or policies;
- changes to commercial agreements;
- changes to platform eligibility requirements;
- exclusivity requirements;
- the withdrawal or unavailability of third-party content;
- the discontinuation of software or services that we rely upon;
- circumstances outside Teaching Autism's reasonable control; or
- changes reasonably necessary to continue operating the relevant product or service.
Where a change materially affects an existing paid product or service, Teaching Autism will take reasonable steps to communicate the change where appropriate and will respect any rights or remedies available under applicable law.
14. Third-Party Platform and Marketplace Changes
Teaching Autism relies on third-party marketplaces, website providers, hosting services, course and membership platforms, payment processors, email providers, software companies, and other third-party services.
These third parties operate independently and may change their:
- terms and conditions;
- marketplace rules;
- exclusivity requirements;
- eligibility requirements;
- fees;
- commission structures;
- functionality;
- technical requirements;
- permitted business practices;
- content policies;
- licensing arrangements; or
- availability.
Teaching Autism cannot guarantee that any third-party service will remain available or continue operating under its current terms.
Where a third-party change materially affects our ability to provide a Teaching Autism product or service in its existing form, we may reasonably need to modify, restructure, relocate, replace, suspend, or discontinue affected elements.
Where reasonably practicable, Teaching Autism will seek to minimize disruption to existing customers.
Depending upon the circumstances and the customer's legal rights, we may offer measures such as:
- continued access through another method;
- migration to another platform;
- replacement content;
- alternative digital resources;
- a substitute Teaching Autism product or service;
- Teaching Autism account or store credit;
- a selection of Teaching Autism resources of reasonably comparable value;
- another reasonable alternative agreed with the customer; or
- an appropriate refund or other remedy where required by applicable law.
Teaching Autism will not use this provision simply to remove material paid-for benefits without a genuine reason.
Nothing in this section limits any statutory right to a refund, price reduction, cancellation, or other remedy.
15. Discontinuation of a Membership, Product or Service
Teaching Autism may sometimes need to discontinue a membership, subscription, course, service, resource library, product line, platform, or feature.
This may occur because of business changes, third-party platform requirements, marketplace restrictions, changes in law, technology changes, licensing issues, insufficient technical support, commercial viability, or circumstances outside our reasonable control.
Where discontinuation affects an existing paid customer, Teaching Autism will consider the nature of the product, the remaining paid access period, the content or benefits already supplied, and applicable consumer rights.
Where appropriate, we may provide continued access, replacement resources, an alternative product or service, credit, comparable-value resources, another mutually agreed solution, or a refund/remedy where legally required.
16. Lifetime Access
Where Teaching Autism sells a product described as providing “lifetime access,” “lifetime membership,” or similar wording, “lifetime” refers to the lifetime of the applicable Teaching Autism product or service rather than the lifetime of the purchaser, unless the applicable offer expressly states otherwise.
Lifetime access does not guarantee that:
- a particular website or platform will operate forever;
- every feature will remain unchanged;
- every individual resource will remain available permanently;
- Teaching Autism will use the same third-party provider indefinitely; or
- no reasonable changes will ever be made to the product.
If Teaching Autism materially restructures or discontinues a lifetime product, we will consider reasonable alternative access or another appropriate remedy having regard to the nature of the original offer, the period for which access has already been provided, and applicable law.
17. Courses and Training
Teaching Autism may provide online courses, professional development, workshops, training programs, recordings, downloadable materials, certificates, or related educational services.
Unless otherwise stated, purchasing a course gives access only to the purchaser.
Course login details, recordings, handouts, downloads, presentation materials, and other protected course content must not be shared with colleagues or other individuals unless the purchase includes group access.
Purchasing a course does not grant permission to reproduce, teach, resell, distribute, or create competing training based substantially upon Teaching Autism course materials.
Where a school or organization requires multiple staff members to access training, an appropriate group or organizational license may be required.
18. Collaborative and Black Friday Bundles
Teaching Autism may organize collaborative bundles, including Black Friday bundles and other limited-time promotions involving products from multiple independent creators.
These bundles bring together resources contributed by participating creators and make them available under the terms advertised for the particular promotion.
Unless otherwise stated:
- each contributing creator retains ownership and copyright in their individual resources;
- purchasing the bundle does not transfer ownership of any intellectual property;
- bundle resources are licensed for individual/personal or single-classroom use;
- purchasers may not redistribute, resell, publicly upload, or share bundle resources;
- access may only remain available for the period stated on the sales page;
- purchasers are responsible for downloading resources within any clearly advertised download or access period; and
- access to a collaborative bundle does not necessarily include future updates to each contributor's individual products.
Any specific terms displayed on the sales page for a particular bundle form part of the terms of that offer.
19. Time-Limited Bundle Access
Some collaborative bundles may provide access to a download portal, website, course area, or other delivery system for a limited period.
Where Teaching Autism clearly advertises a download deadline or access period before purchase, customers are responsible for downloading and securely storing the files they wish to retain during that period.
Teaching Autism does not guarantee indefinite access to a time-limited bundle after the advertised access period expires.
Expiry of a clearly disclosed access period does not transfer ownership of the content or create a new license.
Nothing in this section limits statutory consumer rights.
20. Bundle Contributors and Third-Party Content
Independent creators participating in a collaborative bundle remain responsible for the content they contribute and retain their applicable intellectual property rights.
Teaching Autism may remove, substitute, or replace a contributor's product where reasonably necessary because of:
- copyright or intellectual property concerns;
- technical problems;
- corrupted or inaccessible files;
- contributor withdrawal;
- a legal requirement;
- platform requirements;
- licensing concerns; or
- another genuine reason that makes continued distribution inappropriate or impracticable.
Where reasonably practicable, Teaching Autism may replace removed content with another resource or otherwise take reasonable steps to preserve the overall nature and value of the bundle.
The withdrawal or replacement of one contributor or resource does not automatically entitle a purchaser to reject the entire bundle where the overall product remains substantially as described, subject always to applicable consumer law.
21. Affiliate and Referral Links
Teaching Autism may participate in affiliate, referral, ambassador, partner, or similar programs operated by third-party businesses.
If you click a Teaching Autism affiliate or referral link and subsequently purchase a product, create an account, subscribe to a service, or complete another qualifying action, Teaching Autism may receive a commission, referral fee, account credit, recurring commission, or another benefit.
This will normally not increase the price you pay unless clearly stated otherwise.
Where you create an account with a third-party service through a Teaching Autism affiliate or referral link, your relationship with that third party is governed by that third party's own terms and policies.
Teaching Autism does not control:
- whether the third party accepts your application;
- whether your account remains active;
- the features offered by the third party;
- the third party's pricing;
- commission calculations;
- tracking or attribution systems;
- payment schedules;
- eligibility rules;
- future program changes; or
- decisions to suspend, change, or discontinue the third-party program.
Teaching Autism cannot guarantee that a referral or affiliate relationship will remain active indefinitely.
22. Teaching Autism Affiliate Programs
Where Teaching Autism operates its own affiliate or referral program, additional affiliate terms may apply.
Participation in a Teaching Autism affiliate program does not create an employment relationship, partnership, joint venture, agency relationship, or franchise.
Affiliates are responsible for complying with applicable advertising, disclosure, consumer protection, tax, and other legal requirements.
Affiliates must clearly disclose their commercial relationship with Teaching Autism where required.
Teaching Autism may refuse, suspend, or terminate affiliate participation where there is fraud, misleading advertising, spam, brand misuse, self-referral contrary to program rules, manipulation of tracking systems, or another material breach of the applicable affiliate terms.
Specific commission rates, qualifying purchases, payment thresholds, attribution periods, and other program rules may appear separately within the applicable affiliate program.
23. Prices and Currency
Teaching Autism may display prices in US dollars, British pounds sterling, or another currency depending on the website, product, checkout system, or customer location.
The applicable price will appear before purchase.
Currency conversion rates and foreign transaction charges may be determined by your bank, card issuer, payment provider, or other financial institution.
Teaching Autism does not control additional charges imposed independently by your payment provider.
24. Taxes
Applicable taxes may be included in the displayed price or calculated during checkout depending on the product, customer's location, applicable law, and payment platform.
Customers remain responsible for any taxes or charges that applicable law places directly upon them.
25. Payment Processing
Teaching Autism uses third-party payment processors.
By making a purchase, you authorize the applicable payment processor to process your payment information and charge the amount displayed at checkout.
Teaching Autism does not necessarily receive or store your complete card information.
Payment processors may apply their own terms, privacy policies, security procedures, or account requirements.
26. Failed and Overdue Payments
If a recurring membership or payment plan payment fails, the applicable payment system may automatically retry the payment.
Teaching Autism may temporarily suspend access where an amount remains legitimately unpaid.
Suspension for non-payment does not waive amounts already properly due under the applicable agreement.
If you believe a charge is incorrect, please contact Teaching Autism so that we can investigate.
27. Promotions, Discounts and Coupons
Teaching Autism may offer sales, coupons, promotional pricing, introductory offers, or limited-time discounts.
Unless otherwise stated:
- promotions apply only during the advertised period;
- discounts cannot normally be applied retrospectively to previous purchases;
- promotional codes may have eligibility restrictions;
- promotions cannot necessarily be combined;
- Teaching Autism may correct obvious promotional errors; and
- promotional terms displayed with a particular offer form part of that promotion.
Nothing in this section affects statutory rights.
28. Refunds and Cancellation Rights
Refund and cancellation eligibility depends upon the type of product or service purchased, how it was supplied, where the customer is located, applicable consumer law, and the circumstances of the request.
Our separate Refunds, Returns & Cancellation Policy forms part of these Terms where applicable.
Nothing in these Terms removes any refund, cancellation, repair, replacement, price reduction, or other remedy that applicable law gives you.
29. Immediate Digital Content
Where applicable law provides a cancellation period for digital content, Teaching Autism may ask you to expressly consent to receiving or accessing the digital content immediately and to acknowledge that beginning supply may affect or end your statutory cancellation right.
Where required, this consent and acknowledgement will appear during the purchasing or delivery process.
If applicable law requires Teaching Autism to provide a cancellation right because the necessary consent or acknowledgement was not obtained, these Terms do not override that right.
30. Duplicate Purchases
If you accidentally purchase the same Teaching Autism product more than once through the same Teaching Autism platform, please contact us.
Where we can verify a genuine duplicate purchase, we may provide an appropriate remedy.
Purchases made through separate third-party marketplaces may need to be addressed through the marketplace that processed the relevant transaction.
31. Third-Party Marketplace Purchases
Teaching Autism resources may also be sold through third-party marketplaces.
Purchases made through a third-party marketplace may additionally be governed by that marketplace's terms, payment processes, refund procedures, and account systems.
Where the marketplace controls the transaction, Teaching Autism may be unable to issue a refund, transfer the purchase, alter the transaction, or provide access through a separate Teaching Autism account.
Purchasing a resource on one platform does not automatically entitle you to access the same resource through another platform.
32. Third-Party Websites and Services
Teaching Autism websites and products may contain links to third-party websites, products, tools, platforms, or services.
A link does not mean that Teaching Autism controls that third party.
Third-party services operate under their own terms and privacy policies.
Teaching Autism is not responsible for independent changes made by third-party providers, subject to any responsibility that applicable law requires us to retain.
33. Availability and Technical Issues
We take reasonable steps to keep our websites, memberships, courses, downloads, and digital services available.
However, uninterrupted access cannot be guaranteed.
Temporary interruptions may occur because of:
- maintenance;
- software updates;
- hosting outages;
- payment provider problems;
- internet failures;
- security incidents;
- third-party service disruption; or
- circumstances outside our reasonable control.
Where a technical issue substantially prevents access to something you have paid for, please contact Teaching Autism so that we can investigate and, where appropriate, restore access or provide another suitable remedy.
34. Customer Responsibility for Downloads
Where a product is supplied as a downloadable file and ongoing cloud access is not expressly included in the purchase, customers should download and securely back up their purchased files.
Teaching Autism does not guarantee that every historic product will remain hosted indefinitely unless continuing access forms part of the applicable purchase.
This does not affect any legal obligation to provide content or a remedy where applicable.
35. Educational Information Disclaimer
Teaching Autism provides educational resources and information.
Teaching Autism content does not constitute individualized medical, psychological, therapeutic, legal, or other regulated professional advice.
Educators, families, and professionals remain responsible for deciding whether a particular activity, strategy, resource, or approach is appropriate for an individual learner and for complying with their own professional responsibilities.
36. Results
Teaching Autism does not guarantee a particular educational, professional, financial, behavioral, developmental, or other outcome from using a resource, course, membership, training program, or other product.
Individual outcomes depend upon many factors outside Teaching Autism's control.
37. Website Use
You must not:
- attempt to gain unauthorized access to our systems;
- interfere with website security;
- introduce malware or harmful code;
- scrape protected content in violation of these Terms;
- use automated systems to make excessive or abusive requests;
- impersonate another person;
- use another person's account without permission;
- attempt to circumvent access restrictions; or
- use Teaching Autism websites for unlawful purposes.
38. Account Suspension and Termination
Teaching Autism may suspend or terminate access where we reasonably believe a user has materially breached these Terms.
Examples include:
- deliberate copyright infringement;
- unauthorized sharing;
- reselling resources;
- widespread account sharing;
- fraudulent payment activity;
- serious security misuse;
- unauthorized commercial exploitation; or
- repeated material violations after warning where a warning is appropriate.
Where appropriate, we will consider the seriousness of the breach before taking action.
Termination for misuse does not transfer ownership or intellectual property rights to the customer.
Nothing in this section affects any statutory rights.
39. Chargebacks and Payment Disputes
If you believe Teaching Autism has charged you incorrectly, please contact us so that we can investigate.
Customers retain any legal right to dispute a transaction with their payment provider.
However, knowingly making a false or fraudulent chargeback claim, including falsely claiming that an authorized purchase was unauthorized, may result in suspension of access and recovery action where legally appropriate.
Teaching Autism may provide relevant transaction records, login records, access information, communications, or other appropriate evidence to a payment processor or financial institution when responding to a payment dispute, subject to applicable data protection law.
40. Intellectual Property Complaints
Teaching Autism respects the intellectual property rights of others.
If you reasonably believe content available through Teaching Autism infringes your intellectual property rights, please contact us with sufficient information to identify the relevant content and explain your concern.
Teaching Autism may temporarily remove or restrict disputed content while investigating a credible complaint.
41. Errors and Corrections
We make reasonable efforts to ensure that product descriptions, prices, sales pages, and other information are accurate.
Occasional typographical, technical, pricing, or administrative errors may occur.
Teaching Autism may correct genuine errors where doing so does not unlawfully deprive a customer of contractual or statutory rights.
If a material error affects an order, we will take reasonable steps to contact the affected customer and provide an appropriate solution.
42. Disclaimer of Warranties
Teaching Autism aims to provide high-quality educational content and reliable digital services.
However, except for rights or guarantees that cannot legally be excluded, we do not guarantee that our website will always operate without interruption or that every resource will be suitable for every individual learner, classroom, device, software configuration, or educational setting.
Nothing in these Terms excludes statutory guarantees or consumer rights that apply to digital content, goods, or services.
43. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Subject to applicable law, Teaching Autism will not be responsible for losses that were not reasonably foreseeable when the contract was formed or losses resulting from circumstances outside our reasonable control.
Where you purchase as a consumer, nothing in these Terms limits the consumer protections available to you under applicable law.
Where a product is purchased wholly for business or professional purposes, additional limitations permitted by law may apply.
44. Privacy
Teaching Autism processes personal information in accordance with its applicable Privacy Policy.
Our Privacy Policy explains the types of information we collect, why we process it, who we may share it with, how long we retain it, and the rights available to individuals under applicable data protection law.
45. Communications
By purchasing a product or creating an account, you agree that Teaching Autism may send transactional communications reasonably necessary to administer your purchase or account.
These may include:
- purchase confirmations;
- receipts;
- download information;
- account notifications;
- membership notices;
- billing information;
- security notices;
- significant service changes; and
- other communications necessary to fulfil the contract.
Marketing communications are handled separately in accordance with applicable law and your marketing preferences.
46. Changes to These Terms
Teaching Autism may update these Terms from time to time to reflect changes in our business, products, technology, legal obligations, third-party services, or operating practices.
The current version will appear on this page with its most recent update date.
Changes will generally apply prospectively.
Where a proposed change would materially alter an existing customer's paid contractual rights or obligations, Teaching Autism will not rely solely on continued website use as acceptance of that material change.
Where appropriate, we will provide reasonable notice, seek agreement where required, or provide any cancellation or other remedy required by applicable law.
47. Consumer Rights
Nothing in these Terms excludes, restricts, or attempts to waive rights that applicable consumer law gives you and that cannot lawfully be excluded.
If there is a conflict between these Terms and a mandatory consumer protection law that applies to your purchase, the mandatory legal protection takes precedence.
48. Governing Law
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply based on the customer's place of residence.
If you are a consumer residing elsewhere, you may also benefit from mandatory protections available under the laws of your country or jurisdiction.
Nothing in these Terms is intended to prevent a consumer from exercising any right to bring proceedings in a court available to them under applicable law.
49. Severability
If a court or other competent authority determines that part of these Terms is invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.
50. No Waiver
If Teaching Autism does not immediately enforce a provision of these Terms, this does not necessarily mean that Teaching Autism has waived its right to enforce that provision later.
51. Entire Agreement
These Terms, together with any applicable product-specific terms, license terms, sales-page terms, Refunds and Returns Policy, Privacy Policy, and other terms expressly incorporated into a purchase, form the agreement governing that purchase or use of the relevant service.
Where a product-specific term expressly differs from a general provision in these Terms, the more specific term will apply to that product to the extent of the difference, subject to applicable law.
